Terms of Service

These Terms of Service govern your use of the Smartest Phone Deals website and purchases made from Smartest Phone Deals (Pty) Ltd.

By using our website, placing an order or completing a purchase with Smartest Phone Deals, you agree to these Terms, subject at all times to your rights under applicable South African law.

1. About Smartest Phone Deals

Smartest Phone Deals sells iPhones and related products through two primary purchasing methods:

• Website orders, which are placed and paid for online and fulfilled by delivery; and

• Payment-on-collection purchases, which are arranged directly with Smartest Phone Deals and completed at a confirmed appointment with a Smartest Phone Deals consultant.

Product availability, pricing and payment options may differ depending on the purchasing method.

2. Product Information

We take reasonable care to ensure that product descriptions, specifications, pricing and availability are accurate.

Where applicable, the condition, grade, battery health, storage capacity, colour and other relevant device information are disclosed in the product listing or before purchase.

Product images are intended to represent the product accurately but may not depict the exact individual device supplied unless specifically stated.

Normal cosmetic wear consistent with an advertised device grade does not constitute a fault.

Colour Availability

Device colours are subject to stock availability.

Where a preferred colour is selected, Smartest Phone Deals will make reasonable efforts to fulfil the order in that colour.

If the selected colour is unavailable, we'll contact the customer before fulfilment to confirm an available alternative.

An alternative colour will not be supplied without the customer's agreement.

3. Pricing

All prices are displayed in South African Rand (ZAR) unless otherwise stated.

Prices, promotions and product availability may change without notice.

If an obvious pricing, technical or listing error occurs, Smartest Phone Deals may correct the error and, where legally permitted, cancel an affected order.

If payment has already been received for an order that we are unable to fulfil, the applicable amount paid will be refunded.

4. Orders & Availability

All products are subject to availability.

Submitting a website order or making purchase arrangements does not guarantee stock until the applicable order or purchase has been confirmed by Smartest Phone Deals.

Website orders are subject to successful payment or payment approval, stock availability and any reasonable verification requirements.

We may decline or cancel an order where reasonably necessary, including where stock is unavailable, payment cannot be verified, fraud is reasonably suspected or an obvious listing error has occurred.

Where Smartest Phone Deals cancels an order after payment has been received, the applicable amount paid will be refunded.

5. Payments

Available payment methods depend on how the purchase is made.

Website Orders

Website orders must be paid for using the payment options available at checkout.

Website orders are processed for delivery and are not available for collection.

Instalment, credit or alternative payment facilities displayed on the website are subject to the relevant third-party provider's eligibility requirements, approval process and terms.

Smartest Phone Deals does not control approval decisions made by independent payment or finance providers.

Payment on Collection

Payment-on-collection purchases are arranged directly with Smartest Phone Deals before the collection appointment and are separate from website orders.

Payment is completed at the scheduled appointment using an accepted payment method communicated by Smartest Phone Deals.

6. Special Order Products

Certain products may be supplied on a Special Order basis.

Special Order products may have different stock availability, fulfilment or delivery arrangements, which will be disclosed before or during purchase where applicable.

Where a Special Order product is specified as website order and delivery only, it will not be available for payment on collection.

Your statutory consumer rights remain unaffected.

7. Payment-on-Collection Appointments

Smartest Phone Deals offers payment-on-collection purchases by appointment only at selected collection points.

A collection is a scheduled appointment with a Smartest Phone Deals consultant, who will meet the customer at the confirmed collection point to complete the purchase.

Available collection points currently include:

• Sandton City, Johannesburg

• Campus Square, Johannesburg

• Mall of Africa, Midrand

• Menlyn Park Shopping Centre, Pretoria

• Brooklyn Mall, Pretoria

These collection points are not Smartest Phone Deals retail stores or walk-in locations.

Customers should not arrive at a collection point without a confirmed appointment with a Smartest Phone Deals consultant.

The collection point, date and time must be arranged and confirmed in advance and are subject to stock and consultant availability.

Where applicable, customers will have the opportunity to inspect the device and confirm its condition and functionality at the appointment before completing the purchase.

8. Shipping & Delivery

Nationwide delivery is available for eligible website orders.

Delivery fees, estimated delivery timeframes and other delivery conditions are set out in our Shipping Policy.

Customers are responsible for providing complete and accurate delivery and contact information when placing an order.

9. Device Condition, Grading & Battery Health

Where applicable, the condition and grade of a device are disclosed before purchase.

A-Grade and B-Grade devices may have been previously used, and their cosmetic condition will correspond with the grade advertised.

Battery health information is disclosed where applicable. Battery health naturally reduces through normal use and may change after purchase.

Cosmetic wear consistent with the advertised grade, or battery health consistent with what was disclosed at the time of purchase, does not on its own constitute a device fault.

10. Returns, Exchanges & Warranty

Returns, exchanges, device faults and warranty claims are governed by our Warranty, Returns & Exchange Policy.

Smartest Phone Deals provides its stated commercial warranty on eligible devices in addition to applicable statutory consumer rights.

Nothing in our commercial warranty or these Terms replaces, restricts or limits any consumer right that cannot lawfully be excluded under South African law.

11. Clearance Deals

Products identified as Clearance Deals are subject to the conditions disclosed in our Warranty, Returns & Exchange Policy.

Clearance Deals do not qualify for our voluntary 7-day return or exchange policy.

This does not exclude or restrict statutory rights that may apply where goods are defective or otherwise fail to meet applicable legal requirements.

12. Website Use

You may not use the Smartest Phone Deals website:

• For unlawful or fraudulent purposes

• To interfere with the security or operation of the website

• To gain or attempt to gain unauthorised access to systems or information

• To transmit malicious software or harmful code

• To impersonate another person

• To deliberately provide false or misleading information

We may restrict access where reasonably necessary to protect Smartest Phone Deals, our customers, systems or service providers.

13. Intellectual Property

Unless otherwise stated, the Smartest Phone Deals name, branding, original website content, graphics and other original materials are owned by or licensed to Smartest Phone Deals.

These materials may not be reproduced, copied or used commercially without permission, except where permitted by law.

Third-party trademarks, product names and logos remain the property of their respective owners.

14. Third-Party Services

Our website and sales processes may use services provided by independent third parties, including payment providers, finance providers, couriers and technology platforms.

Third-party services may be governed by their own terms and privacy policies.

Smartest Phone Deals is not responsible for the independent acts or services of third parties except to the extent that responsibility cannot lawfully be excluded.

15. Privacy

Personal information is processed in accordance with our Privacy Policy and applicable South African data-protection law.

16. Limitation of Liability

To the fullest extent permitted by law, Smartest Phone Deals will not be liable for indirect or consequential loss arising solely from the use of our website or circumstances outside our reasonable control.

Nothing in these Terms excludes, limits or waives any liability or consumer right where doing so is prohibited by the Consumer Protection Act or other applicable South African law.

17. Changes to These Terms

We may update these Terms from time to time to reflect changes to our website, products, services, business practices or legal requirements.

The version applicable at the time a transaction is concluded will apply to that transaction unless applicable law requires otherwise.

18. Governing Law

These Terms are governed by the laws of the Republic of South Africa.

Nothing in these Terms prevents a consumer from exercising any right or remedy available under applicable consumer protection legislation.
